Terms of sale
These terms cover buying from this shop. We have written them to be read rather than to be survived, and nothing in them takes away a right you have under state or federal law.

Primesavour, Inc., 1 Grove Terrace, Homestead, FL 33030. We buy crop from growers, receive and grade it in our own warehouse, and sell it to you as the merchant of record. You are buying from us, not from a grower through us, and our name is on the receipt.
Adding something to a basket does not reserve it. The sale is made when we accept your order, which is when we send the confirmation email. If we cannot fulfil an order after taking payment, we cancel it and refund you in full.
We may decline an order if the item has sold out between your checkout and our confirmation, if the delivery address is outside every area we serve, or if we reasonably suspect fraud.
Prices are in US dollars and shown before tax. Applicable state and local sales tax is calculated at checkout on the delivery address.
Produce is sold by the pound, by the pack or by the item, at the weight stated on each listing. Natural produce varies, so a pack may differ from its stated weight by up to ten percent either way. If it falls short by more than that, tell us and we refund the difference.
A price shown alongside a struck-through price is a genuine reduction from the price we were charging for that item before the reduction began.
We do not substitute. If we cannot supply something you ordered, we tell you before it leaves the warehouse and take that line off your order, rather than sending you something you did not choose.
Within our own radius we deliver with our own refrigerated fleet, usually the same day. Beyond it we use a contracted cold-chain courier and the arrival window is theirs, not ours. Checkout tells you which applies to your address, and what it costs, before you pay.
Somebody should be there. If you ask us to leave a box unattended we will, but from the moment it is left at the address you gave us, the risk and the condition of the produce are yours. Perishable food left in the sun is not a delivery failure.
Title and risk pass to you on delivery, or on the box being left where you asked us to leave it.
Every lot is graded before sale and we sell only what passed. We promise that what we send you matches its description and was fit to sell when it left our cold store. What we cannot promise is how a living thing behaves in your kitchen after two days.
If something arrives in a condition that would not have passed our own inspection, our refunds policy applies, and it is part of these terms.
Our warehouse handles tree nuts, shellfish and a wide range of fresh produce, and we cannot guarantee that any item is free of cross-contact. If you have a severe allergy, please write to us before ordering.
Wash produce before eating it. Some of what we sell has skin, stones or seeds that are not for eating, and listings say so where it matters. Raw poultry, eggs and seafood carry their own handling instructions on the product page and the pack.
Keep your sign-in details to yourself. Tell us promptly if you think somebody else has them. We may suspend an account we reasonably believe is being used fraudulently, and we will tell you why.
We are responsible for loss you suffer as a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, or for business losses.
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Some states do not allow certain limitations, and where that is so, these limits do not apply to you.
These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Disputes go to the state or federal courts sitting in the county of our warehouse.
Before that, please write to us. Nearly everything is settled by an email and a photograph, and we would rather do that.
We may update these terms. The version that applies to your order is the one published when you placed it, and the date at the top of this page tells you which that is.
